Hello, my name is Morana and I am an experienced artist who works with both digital and traditional media. I create original and custom artwork for various purposes and occasions.

This text is a term of service agreement that outlines the conditions and expectations for our collaboration. The purpose of this agreement is to protect both of us from any potential legal issues, such as infringement, misuse, or unauthorized distribution of the artwork. It also clarifies the ownership and usage rights of the artwork, as well as the payment and delivery terms.

By commissioning me to create an artwork for you, you agree to abide by the following terms:

You will pay me the agreed-upon fee of 50% upfront and the rest, full and on time, as specified in the invoice. The fee includes the cost of materials, time, labor, and shipping (if applicable).

You will provide me with clear and detailed instructions and feedback on the artwork, and allow me reasonable time and creative freedom to complete it according to your specifications.

You will not use the artwork for any commercial purposes, such as selling, licensing, or advertising, without my prior written consent. You will also not create or distribute any derivative works based on the artwork, such as NFTs, NSFW content, or edits, without my prior written consent.

You will respect my moral rights as the artist and credit me appropriately whenever you display or share the artwork, either online or offline. You will also not claim the artwork as your own or remove any signatures or watermarks that I may have added to it.

I will retain the full ownership and intellectual property rights of the artwork unless we agree otherwise in writing. You will have a non-exclusive license to use the artwork for personal, non-commercial purposes only, as long as you comply with the terms of this agreement.

I will deliver the artwork to you in the agreed-upon format and method, either digitally or physically, within the agreed-upon timeframe. I will also provide you with a copy of this agreement and a receipt of payment.

I will not be liable for any damages or losses that may occur during or after the delivery of the artwork, such as theft, loss, or deterioration. I will also not be responsible for any disputes or claims that may arise from your use or misuse of the artwork.

I will not offer any refunds or exchanges once the artwork is completed and delivered unless there is a major defect or error that is attributable to me. In that case, I will try to fix the issue or offer reasonable compensation, at my discretion.
